ICE has done this before too:

ICE in Chicago rammed a womans car, shot her multiple times, arrested her claiming she rammed them and pulled a gun.

Charges were dropped because video proved ICE was full of it.

No charges against the ICE agents who rammed a citizen, shot a citizen multiple times, falsified reports on the incident, and concealed evidence (they had the car ICE used repaired before charges were dropped, preventing the damage evidence from being used to demonstrate who rammed who).

We are under a fascist- weak, inept fascists right now - but a fascist Government nonetheless. There are no consequences for abusing U.S. citizens. It is our Governments goal to harm as much as they can without consequences and the more they do get away with the further they will go.

The ICE agent created his own exigent circumstances. The vehicle was being used as a means of escape, not as a weapon. Deadly force was not justified.

At the time shots were fired, the agent could have simply stepped to his right to avoid the vehicle. There was no imminent threat of death or serious bodily injury. Shooting into a fleeing, unarmed vehicle under these circumstances is something most trained law enforcement officers know is not lawful.

Courts across the country have consistently held that flight alone does not justify deadly force. An officer must face an immediate and unavoidable threat — not a situation of their own making.

This constitutes an unreasonable seizure under the Fourth Amendment, and the use of deadly force here was excessive and unnecessary.

For those saying this is “standard procedure,” it isn’t. Here are some relevant cases:

• Scott v. Harris (2007) – Even here, the Supreme Court made clear that fleeing alone doesn’t justify deadly force; the ruling hinged on extreme danger to the public.
• Gonzalez v. City of Anaheim (9th Cir. 2014) – Shooting into a fleeing, unarmed vehicle was ruled objectively unreasonable; no qualified immunity.
• Mattos v. Agarano (9th Cir. 2011) – Firing at a car trying to flee a DUI stop was excessive force.
• Estate of Cherry v. City of Hamilton (6th Cir. 2018) – Shooting at a slowing, fleeing van was unjustified as a matter of law.
• Baynes v. Cleland (9th Cir. 2001) – A fleeing car is not automatically a deadly threat.
• Perea v. Baca (9th Cir. 2002) – Deadly force against an unarmed fleeing suspect was unconstitutional.

Fleeing ≠ deadly threat.
Creating danger ≠ justification to shoot.

Two facts are dispositive.

First, the driver placed the vehicle in reverse to increase distance between herself and the agent positioned in front of the car. That action is inconsistent with an intent to strike or run over the agent. If the objective were to cause harm, reversing would have been unnecessary and counterproductive.

Second, the driver turned the steering wheel to the right, away from the agent. At that point, the agent moved to the left side of the vehicle and was no longer in the vehicle’s path. The threat had dissipated. The agent then leaned over the hood, aimed, and fired.

The use of deadly force was not reactive to an imminent threat. It was a discretionary act taken after the threat had ceased.

This was not a justified shooting.
It was an unlawful killing.
