The result would have been the same though: she did in fact break the law. The sentence:

"She was handed a three-month conditional discharge instead of a fine, but also ordered to pay a £26 victim surcharge."

The issue is with DVLA who could have dropped the prosecution on notification of the typo. They have, as per your story, since agreed if it's just a typo to petition to have the conviction quashed.

It's also appropriate that - even with the typo - drivers should be liable. If she ran a pedestrian over and put them in a wheelchair, she would have no insurance cover, and that person would receive no adequate compensation. Certainly, itn isn't malicious that she made a mistake but even such errors carry liability. DVLA ought to be pursuing these cases, though it can always act leniently for a first offence.

Legally speaking she had insurance for a car with the reg plate she wrote, not her actual car with the reg plate she was driving. The insurance company would not have covered any accident involving that vehicle.

Was she guilty of driving without insurance? Yes.

Does that warrant some kind of sanction? Yes, mistakes can really fuck up other people's lives and you need to pay attention.

Was it intentional dodge from which she benefited? No. So it justifies a very low penalty or a warning. But that latter option is for DVLA not the court.

And if the insurer doesn't pay out, then functionally, she's uninsured. The reason we require insurance isn't because we want people to pay money to insurers, it's because we want to know if dotty granny or drunken pillz turns some guy into a quadriplegic, that persons care and future needs will be met.
