Advertisement 2 Story continues below Article content But, instead of the four-year penitentiary penalty proposed by an assistant Crown attorney, a Brantford judge sentenced 31-year-old Darris James Wilson to two years of house arrest for dangerous driving causing death and bodily harm. “These have been the most difficult four-and-a-half years of our lives,” Larry Demelo and Naomi Beverly – Sierra’s parents – said in a statement last week. “We are deeply disappointed that, after waiting so long for justice, the sentence feels so inadequate in light of everything Naomi has endured and continues to endure.” In a written decision, Justice Gethin Edward deplored the death of Sierra and the traumatic injuries to her mother, who was driving her daughter to a sleepover in Tillsonburg when their vehicle was hit on Oakland Road on Feb. 11 at about 4:25 p.m. The family had recently moved to Six Nations but Sierra was still attending Westfield Public School in Tillsonburg remotely. “Over a dozen victim impact statements were filed, each expressing unimaginable loss, upset, grief and anger,” said Justice Gethin Edward, noting he saw marks from the tears of the Crown attorney who read the statements into the record. On the day of the collision, Wilson was seen speeding and drifting out of his lane. Evidence was that he was driving about 90 km/h in a 50 km/h zone, right on the edge of an 80 km/h zone and, when his Dodge Ram smashed into the Beverly sub-compact Mitsubishi, there was no evidence of braking. While police were told Wilson had been drinking, and there were cans of open and unopened beer scattered around the driver’s seat, officers at the scene said they saw no indications he was impaired and didn’t smell alcohol on his breath. The crash left Naomi Beverly with multiple fractures and other serious injuries that eventually put her in an acquired brain injury unit. “Since the accident, Naomi requires attendant care because of her combined … impairments,” said the judge. “She requires 24-hour supervision.” Advertisement 4 Story continues below Article content But the judge also heard from a sentencing circle of Wilson’s family and supporters. He considered how colonialization of the Six Nations band had led to a “major disconnection” to Wilson’s culture that, in turn, led him into “over-consumption of alcohol and unhealthy relationships.” “This crystallized into the tragic events of Feb. 11, 2022,” said Edward. The judge said that connection is exactly what the criminal justice system is trying to address by acknowledging ‘Gladue issues’ brought up through reports that show the impact residential schools, poverty, racism and other systemic factors play in the life of an accused. “The over-representation of Indigenous people in Canada’s prisons is a present-day product of this country’s colonial past,” Edward said in court, quoting a decision by Andromache Karakatsanis. “As Indigenous incarceration rates have climbed … this over incarceration is an ongoing source of intergenerational harm to families and communities. It is a striking sign of the discrimination that Indigenous peoples experience in all parts of the criminal justice system.” Advertisement 5 Story continues below Article content Edward said his sentence could not “erase this country’s colonial past” or remove what caused the offender to commit a crime but a judge is “uniquely positioned” to make the racial inequalities better or worse. The judge considered Wilson’s guilty plea and how he has spent his time since the crash in nature, focusing on cultural teachings and traditional practices, according to his mother. “Mr. Wilson’s efforts to regain his culture, that which was taken from him and his family in a systematic fashion by the Government of Canada, will once again be taken by the state if the court imposes a four-year penitentiary sentence.

The man was sentenced to 2 years house arrest instead of 4 years incarceration at the judges prerogative justified by shifts in Canadian judicial practices. Oh so sad. I understand. Shifts in judicial practices got Rittenhouse off the hook. Quite upsetting until I realized I am not subject to US juristdiction and have not been subject to it even briefly for more than 30 years. I was an early adaptor. I have not been to the hellscape of your country since 1997.

A defendant no longer has to prove he acted in lawful self-defence. The prosecution needs to prove a defendant did not act in lawful self defence. A wierd shift, but it is what it is. Nobody is forcing me to go to the US. Canada has a shift you do not like. Generational harm (that you understand so endlessly well when it comes to Israel) matters and judges can and have chosen to limit perpetuating that harm. You think it is a wierd shift. You just have problems accepting it. Same with the post-partum psychosis case. You are so sad that 11 of 12 jurors accepted the insanity plea and the woman in question remains unconvicted of anything.
